Truck Driver In Tracy Morgan Crash Charged With Manslaughter

A grand jury has indicted the truck driver responsible for severely injuring Tracy Morgan and killing another man, James McNair, during a car crash in June 2014.

Kevin Roper with first-degree aggravated manslaughter, second-degree vehicular homicide and third-degree aggravated assault. The accident occurred on the New Jersey Turnpike on June 7, 2014 while Roper was driving a Walmart truck.

Roper's lawyer had argued that the publicity around the case, including Morgan's settlement with Walmart, wouldn't result in a fair trial for his client and the case was brought to a grand jury.

Morgan suffered brain trauma, broken ribs and a broken leg in the crash. He and other passengers in the limo van were not wearing their seat belts.

However, Roper faces an uphill battle with aggravated manslaughter carrying a 10-to-30-year prison term upon conviction and vehicular homicide carrying a five-to-10-year prison sentence.

An NTSB investigation found that Roper hadn't slept in the 28 hours before the crash and didn't slow down despite posted warning signs on the turnpike in the area of the accident.
