Man Sues Date For Texting During 'Guardians of the Galaxy 2'

An Austin man, 37, has sued his date for $17.31, the price of the 3D movie ticket to the 'Guardians of the Galaxy' sequel because she texted during the movie.

Brandon Vezmar, who has his own communications consulting company, tells the Statesman that he met the woman online and went with her on their first date on May 6.

"It was kind of a first date from hell," he says "This is like one of my biggest pet peeves."

Vezmar says the woman "activated her phone at least 10-20 times in 15 minutes to read and send text messages."

He claims it was a "direct violation" of the theater's policy it "adversely" affected his movie viewing experience.

"While damages sought are modest, the principle is important as defendant’s behavior is a threat to civilized society," he explains.

After Vezmar suggested that his date should go outside to text, she left and never came back. He was also left without a ride because they had come in her car.

He texted her a few days later asking for the price of the ticket but she refused to pay because "he took me out on a date."

"Oh my God," the 35-year-old woman tells the paper. "This is crazy. I had my phone low and I wasn't bothering anybody. It wasn't like constant texting."

"I'm not a bad woman," she insists. "I just went out on a date."

James Gunn, the film's director, joked on social media: "Why stop at suing? She deserves jail time!"

Thankfully, Alamo Drafthouse CEO Tim League has offered a gift certificate to settle the lawsuit.

"To save the time of the courts, the Alamo is willing help put this to bed and hereby offers Vezmar a gift certificate in the amount of $17.31 for his next cinema outing," League says in the offer.
